NEWS | SEMMES DEFEATS CLAIMANT’S FEDERAL SUIT FOR DOUBLE DAMAGES SOUGHT UNDER THE MEDICARE AS SECONDARY PAYER ACT

Semmes Principal Anthony J. Zaccagnini and Associate Shiva Z. Kashani successfully defended a third party administrator in the United States District Court for the District of Maryland. A Maryland workers' compensation claimant filed a Federal suit under the Medicare as Secondary Payer Act, 42 U.S.C. Section 1395y, "on behalf of Medicare" against his employer, its workers' compensation insurer, and its third party administrator to recover double the amount of "conditional payments" made by Medicare. Workers' compensation claimants can, in some instances, recover "double damages" if the workers' compensation carrier, as the "primary payer," does not reimburse Medicare, which is a "secondary payer," for medical treatment and services causally related to the claimant's accidental injury. With the prompt filing of a Motion to Dismiss, Semmes efficiently and effectively defeated the suit.
