The District Of Columbia Update

A limited number of forms routinely used in workers' compensation claims in the District of Columbia can now be downloaded from the Internet. The Department of Employment Services has a new web site which makes these forms available. The Internet address for the site is http://does.ci.washington.dc.us. Once at the site, click first on the line entitled "DOES Forms/Information Available Online." Then click on the line entitled "Workers' Compensation Forms and Information" where the following forms can be found:

OWC Form 7: Employee's Notice of Accidental Injury or Occupational Disease

OWC Form 7A: Employee's Claim Application

OWC Form 8: Employer's First Report of Injury or Occupational Disease/p>

OWC Quarterly Premium Surcharge Payment Form Employee's Rights and Obligations Information Sheet

It should be noted that the latest amendments to the D.C. Workers' Compensation Act effective April 16, 1999, require employers to send to claimants a copy of the Employee's Rights and Obligations Information Sheet with a copy of Form 8 when filing the original Form 8 with the Office of Worker's Compensation. Any employer which fails to send both the Form 8 and the Information Sheet to the claimant or the claimant's next of kin by certified mail, return receipt requested, could be subject to a civil penalty not to exceed $1,000.00 for each such failure; furthermore, the one year statute of limitations will not begin to run against the claim until the employer complies with this new requirement.
